Bicyclist Sally Edwards Killed in Marietta, NC Bike Accident
A woman named Sally Edwards was tragically killed last Friday in an accident while riding her bicycle. The accident happened on N.C. 41 around 8:11 p.m. According to reports, Ms. Edwards was riding her bike in the center lane when she was struck from behind by a pickup truck.
Investigating officers from the NC State Highway Patrol have indicated that Ms. Edwards was at fault for not having a headlamp on her bike and for not wearing reflective gear. In accidents where the bicyclist is struck from behind, we do not believe that the use of a front headlamp should determine who was at fault. Indeed, there is caselaw from the North Carolina appellate courts that supports a conclusion that a headlamp may not be relevant in a rear-ended collision. The news reports do not discuss whether Ms. Edwards’ bicycle had any rear-directed reflectors under her seat or on her pedals. If so, these reflectors should have been sufficient for the on-coming pickup to have seen Ms. Edwards.
