A terrible accident on Tuesday in Robeson County has resulted in the death of a young boy riding a bicycle with his friend.
The accident happened around 6:35 pm on Russell Road about 3 miles west of Rennert, North Carolina. According to available information, Jacoby Locklear and his friend Aiden Lupo were both riding on the same bicycle when they were hit by James Davis. Apparently, Mr. Davis crossed the center-line and hit the boys as they road on the shoulder of the road. Aiden Lupo, who was 11 years old, did not survive the wreck. Jacoby Locklear was taken to a hospital in Florence, South Carolina for treatment of serious injuries.
Mr. Davis has been charged with multiple crimes including DWI and misdemeanor death by motor vehicle.

A gentleman named Tyler Sims was riding his bicycle along North Center Street in Hickory, North Carolina on Monday morning when he was hit by a driver who has now been charged with DWI among other crimes.
The accident happened around 8:15 am and the bicyclist was thrown nearly 50 feet as a result of the crash. Apparently, the DWI driver crossed the center line and hit Mr. Sims as he rode along the shoulder. Mr. Sims was wearing a helmet but was not able to survive the accident.
The driver of the car has also been charged with felony death by motor vehicle and driving left of center.

A recent decision by the North Carolina Court of Appeals went against a bicyclist who was injured in an Orange County, North Carolina accident. The case was not handled by our firm but it presents some interesting and worthwhile issues for bicyclists in North Carolina.
The accident at issue in the case involved a bicyclists who was struck by the passenger-side mirror of a passing motorists. Apparently, the impact broke the mirror but did not knock the bicyclist off the bike. Following the impact, the bicyclist spoke to the car driver who had stopped following the accident. The impact with the mirror left the bicyclist with bruises and an alleged back problem. The case went to trial and the jury found in favor of the car driver. The bicyclist asked the Court of Appeals to overturn the jury’s decision and determine that the car driver was negligent as a matter of law for passing too closely. The Court of Appeals declined to overturn the verdict and determined that there was conflicting evidence on the question of whether the car safely passed the bicyclist.
This case is interesting because North Carolina law requires a passing vehicle to provide at least two feet between the vehicle and the bicyclist. Certainly, in this case it could be argued that there was not at least two feet between the car and the bicyclist – otherwise the accident would not have happened. Yet, the Court of Appeals left the decision to the jury which sided with the car driver.
The lesson for bicyclists in North Carolina is that merely being hit by a car does not automatically mean the car is at fault. I personally disagree with this ruling but we must all now be more careful when riding our bicycles on the roadways of North Carolina.

A woman named Pamela Lane was tragically killed in a bicycle accident on Friday in Chapel Hill, North Carolina.
The accident happened when Ms. Lane was riding her bicycle southbound on the eastern sidewalk of Martin Luther King Jr. Boulevard at around 9:40 am. Apparently, a vehicle exiting the parking lot of a gas station hit Ms. Lane as she rode along the sidewalk. Ms. Lane was 57 years old and was from Durham. Based on available information, there have been no charges brought against the driver of the vehicle and it is not clear what the investigation of local police revealed regarding this accident.

The Town of Chapel Hill, North Carolina has recently started tagging bicycles with brightly colored flyers to raise awareness for bike visibility. The flyers promote the importance of visibility for bicyclists riding at night and reminds bikers to have a white light on the front of the bike and a red reflector on the back of the bike.
The flyers also give the bikers a 10% discount to buy a light at any of the Chapel Hill bike shops. Chapel Hill recently adopted a bike plan and is designated as a national bicycle friendly community.

A gentleman named Matthew Hawkings was riding his bicycle on NC 58 on Monday when he was seriously injured by a hit-and-run motorist.
The accident happened at approximately 12:46 pm as Mr. Hawkings was riding north on NC 58 just outside of Cape Carteret, NC. Apparently, a passing vehicle struck Mr. Hawkings with its side mirror and then fled the scene. The mirror was recovered at the accident scene and the vehicle is believed to be a mid 1990s Chevrolet pickup or possibly a Suburban. Anyone with information about this accident is asked to call the NC Highway Patrol at 252-726-5766.

A gentleman named Robert Fulp was tragically killed while riding his bicycle in Greensboro Thursday morning.
The accident happened at around 6:15 am on Country Club Drive. Apparently, a man driving a Lexusturned into Mr. Fulp’s path. Mr. Fulp survived long enough to be transported to Moses Cohn Hospital but he ultimately passed away as a result of his injuries.
The driver of the Lexus has been charged with misdemeanor death by motor vehicle. Mr. Fulp was 51 years old.

A bicyclist was killed around midnight on Saturday night in an accident on Oleander Drive in Wilmington, NC.
The accident apparently happened when a minivan struck the bicycle from behind in the eastbound lane around the 5800 block of Oleander Drive. The accident was significant enough that the bicyclist died at the scene.
There is not much information about what happened in this accident. If the bicycle had a proper rear reflector, then it would appear proper to charge the driver of the minivan regarding this accident. Hopefully, the investigating officers have retained the bicycle and all of its parts as they may be needed to determine liability.

A teenager riding a bike in Durham NC was seriously injured in a bike accident on Sunday night. The accident happened at the intersection of Gray Avenue and Geerwood Street. As a result of the accident the teen was taken to a local hospital with serious injuries.
It is not clear what happened in this accident and we expect the Durham Police Department to issue an accident report detailing the accident sometime in the near future.

An eight year old boy was seriously injured while riding his bicycle in east Charlotte on Monday evening. The accident involved a vehicle that fled the scene after the accident which happened near Idlebrook Drive. Fortunately, the young boy, named Justis Retamer, will survive and hopefully recover from his serious injuries which include a broken pelvis, broken ribs and a broken shoulder blade.
The police are looking for the driver of the car which, according to witnesses, may have been speeding through the neighborhood where Justis lives. Anyone with information regarding this accident should call the Charlotte-Mecklenburg Police Department.
